FREQUENTLY ASKED QUESTIONS

If I am an active Member and didn’t make it in last month, what do I do?
While we do not offer refunds for your monthly Facial, we understand things can come up, so you may accrue discounted First Facials, up to a maximum of three (3) accrued discounted First Facials at any time. Alternatively, you may elect to receive a gift card for the value of the discounted First Facial as described above (email members@heydayskincare.com).

Can I get a refund if my preferred Skin Therapist is not available that month?
Memberships do not guarantee particular Skin Therapists, appointment times, or locations. If your favorite Skin Therapist isn’t available, reach out to us and we will pair you with someone that matches your particular style and goals!

Can I share my Membership with a friend/coworker/partner/family?
Yes! You can share your First Facial discount with others. To do so, email members@heydayskincare.com or discuss with shop personnel when you come in for your appointment.

How do I cancel my Membership?
You may cancel with no further charges or fees 30 days after written cancellation notice has been received (email members@heydayskincare.com).




FULL MONTHLY MEMBERSHIP AGREEMENT

This Monthly Membership Agreement (“Agreement”) is made between Heyday DMV, LLC, its affiliates, a Delaware limited liability company d/b/a Heyday (referred to herein as “Heyday”, “we”, “our” and “us”), the member listed above (referred to herein as “Member,” “you” and “your”) and, if applicable, the person other than the Member who purchases the Heyday membership described in this Agreement (referred to herein as “Buyer”). This Agreement governs your Heyday membership (“Membership”).

Definitions

“Additional Facials” are defined as any Facial that you receive within a Membership Month after the First Facial.


“Agreement Date” is defined as the date you signed this Agreement.


“Enhancements” are currently defined as one (1) of the following services (which services may be updated from time to time), to be redeemed within the Facial:

  • Gua Sha
  • Microdermabrasion
  • Peel
  • LED Light Therapy

“Facial” is defined as a base facial service (currently 50 minutes) that is available at any Heyday location.


“First Facial” is defined as the first Facial you receive within a Membership Month.


“Products” are defined as retail products available for purchase in the retail section of a Heyday location. Exclusions may apply at certain times.


“Membership Charge Date” is the date that your debit or credit card will be charged for your monthly membership.


“Membership Month” is defined as the period beginning with a Membership Charge Date and ending on the day before the next Membership Charge Date.


Services” are, collectively, the Facials and Enhancements.

Membership and Benefits

By entering into this Agreement and signing up for the Membership, you agree to purchase a Facial on every Membership Charge Date. In addition to your monthly Facial, you’ll receive the follow benefits: $30 off the First Facial; $20 off Enhancements;15% off Products – 20% off of Products at time of signing up for a Membership (only available when a Membership is first purchased); $75 Additional Facials in that Membership Month; Member perks – think Member gear, skincare insider info, first access to new product & tool launches & more – the longer you’re a Member, the more access you have

Monthly Payment
Your card will be automatically charged on the same day of each month.

Minimum Commitment / Cancellation

There is no minimum commitment. If you want to cancel, email us at members@heydayskincare.com. Memberships will be cancelled effective 30 days following our receipt of such cancellation request.

Discount Sharing; Gift Cards
In addition to being able to apply your discounts to Facials for yourself, you also have the following options: 1) let a friend or family member use your First Facial discount for a Facial, or 2) receive a gift card for the value of your discounted First Facial, which may be used for your own product purchases or gifted as you would like! Freezing of your Membership is not allowed in this membership program for any period of time.

Discount Accrual

You can have a maximum of three (3) accrued discounted First Facials at any time. Any accrued discounted First Facials in excess of three (3) at any one time that have not been redeemed or converted to gift cards will be deemed expired.

Product Exchanges
If you aren’t 100% satisfied with your Heyday esthetician recommended Product, you may exchange the Product, up to 14 days post purchase.

Founder’s Rate

Certain shops may offer promotional rates (a “Founder’s Membership Rate”) for those that sign up for monthly membership prior to the opening of such shop. To take advantage of the Founder’s Membership Rate you (i) cannot be a current member at any Heyday and (ii) must live within 50 miles of the shop offering such Founder’s Membership Rate. There is a limit of one (1) Founder’s Membership Rate redemption per person. Such promotion can end at any time with or without notice. The Founder’s Membership Rate is an auto-renewing contract and will bill every month. Memberships canceled after the billing date cannot be refunded. Certain regions may have taxes and surcharges that are not included in your Founder’s Membership Rate.

AGREEMENT TYPES

  1. ACTIVE MEMBERSHIPS
  • No minimum term and non-refundable (except where specified below)
  • Effective on the first Membership Charge Date
  • Discounted First Facials can be accrued, up to THREE (3) at any time; any beyond 3 will expire
  • Discounted First Facials can be shared or converted to gift cards

  1. TRANSFERRED MEMBERSHIPS
  • You may transfer your Membership between Heyday locations.
  • Membership transfer document must be completed at the location you wish to transfer to.
  • After document submission, the Heyday location with your original Membership will have seven (7) days to terminate the Membership so the new Membership can be activated.
  • Existing discounts will not be impacted by the transfer.

  1. CROSS-REGIONAL MEMBERSHIP REDEMPTIONS
  • Discounts may be redeemed at any Heyday location. Additional fees or taxes may apply at the location where the discount is being redeemed.

ADDITIONAL TERMS

  1. CONSUMER’S RIGHT TO CANCELLATION: YOU MAY CANCEL THIS CONTRACT WITHOUT ANY PENALTY OR FURTHER OBLIGATION WITHIN THIRTY (30) DAYS FROM THE AGREEMENT DATE. Notice of cancellation shall be in writing or email by the Member and mailed by registered or certified United States mail to Heyday at: PO Box #1529 at 149 E 23rd St NY,NY 10159 or members@heydayskincare.com. At any time during the term of the Membership, you may cancel with 30 days written notice. Accumulated discounted First Facials expire after 90 days of Membership cancellation.
  2. MEMBER’S HEALTH WARRANTY AND ACCURACY OF INFORMATION: You represent that you are in good health and have no disability, impairment, injury, disease or ailment preventing you from engaging in Services with Heyday. You assume full responsibility for your use of the Heyday facility and shall indemnify Heyday DMV LLC, the owner of the Heyday location you are utilizing, its affiliates, agents and employees against any and all liability arising out of your use of the facilities.
  3. TRANSFERS OF MEMBERSHIP: Membership may not be transferred but you may share your Membership benefits with others, as described above.
  4. MEMBER’S OBLIGATIONS: You shall not be relieved of your obligations to make payments agreed to, and no reduction in any payments due shall be made because of your failure to use Heyday’s services. You must abide by late cancel/no show policies and all fees will be charged to the debit or credit card on file.
  5. ENTIRE AGREEMENT: Except for the rules, regulations and schedules posted at Heyday or issued orally by Heyday from time to time at its discretion, all of which are incorporated into this agreement, this contract constitutes the entire and exclusive agreement between the parties relating to the subject matter hereto and supersedes any oral or other written understanding. This contract may be modified only in writing executed by a duly authorized representative of Heyday. Employees are not authorized to make any independent agreements with any Members and/or Buyers.
  6. UNPAID BALANCES: Members will not be permitted to use any Heyday location until all monthly fees are paid as agreed. You or Buyer, as applicable, is obligated to pay any collection and/or legal costs incurred by Heyday for collection of any fees. Heyday reserves the right to charge balances and overdue balances to the any account you or Buyer has designated for payment under any pre-authorization. To the extent that Member and Buyer are not the same person, Buyer shall be obligated to make all payments that Member fails or has failed to make (including past and future payments for use of Heyday).
  7. VALUABLES AND PERSONAL PROPERTY: Heyday shall not be liable for the loss of or theft of, or damage to, your personal property. You release Heyday of any and all claims, demands, suits, complaints, causes of action or any liability for loss, stolen or damage to your personal property while on the premises. Storage of illegal substances, firearms, and toxic or volatile chemicals is prohibited and punishable by law.
  8. MEMBERSHIP FREEZE POLICY: Members may not freeze their memberships. If upon a doctor’s order, you cannot physically receive the Services because of significant physical disability, you may submit a cancellation request per the instructions noted above in Section 1.
  9. TERMS OF SALE: All sales of service sessions are final and non-refundable.
  10. PRICING: Heyday reserves the right to change the pricing of Services and the Member benefits and will provide thirty (30) days’ notice to all Members regarding any such change in pricing and/or benefits.
  11. REVOCATION OF MEMBERSHIP: Heyday reserves the right to revoke and cancel this Membership at any time for any reason, in which case you will, no later than fifteen (15) days after such cancellation, receive a refund of all monies paid pursuant to this Agreement, provided that Heyday may retain expenses incurred or the portion of the total price of this Agreement representing the services you used or completed, and provided further, that Heyday may demand the reasonable cost of goods and services which you consumed or wish to retain after cancellation.
  12. WAIVER OF LIABILITY: YOU AGREE TO ASSUME, TO THE MAXIMUM EXTENT PERMITTED BY LAW, FULL RESPONSIBILITY FOR YOUR USE OF THE FACILITY AND HEREBY RELEASE HEYDAY FROM ANY AND ALL LOSS, THEFT, CLAIM, INJURY, DAMAGE, OR LIABILITY, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF HEYDAY, ITS AFFILIATES, AGENTS, OR EMPLOYEES. YOU FURTHER AGREE THAT HEYDAY, THE OWNER OF THE RETAIL LOCATION YOU ARE UTILIZING, ITS AFFILIATES, AGENTS AND EMPLOYEES SHALL NOT BE LIABLE ON ANY THEORY OF LIABILITY FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING ANY LOSS OF PROFITS, BUSINESS OR ANTICIPATED SAVINGS), ARISING OUT OF, IN CONNECTION WITH OR AS A RESULT OF THE TRANSACTIONS CONTEMPLATED HEREBY, WHETHER SUCH DAMAGES ARISE IN CONTRACT, WARRANTY, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW OR OTHERWISE. FURTHER, YOU SHALL INDEMNIFY, DEFEND, AND HOLD HARMLESS HEYDAY, THE OWNER OF THE RETAIL LOCATION YOU ARE UTILIZING, ITS AFFILIATES, AGENTS AND EMPLOYEES AGAINST ANY AND ALL LIABILITY ARISING OUT OF YOUR PRESENCE AT OR USE OF THE FACILITIES.
  13. PRESALE CONTRACT CANCELLATION PROVISIONS:

  1. For the purposes of this section, “Presale Contract” means a Membership Agreement that is signed prior to the Membership location official opening and Services being available to the Member.

  1. Presale Contract Members shall have the right to cancel this contract for any reason at any time prior to midnight of the third business day after the date on which the first Service under the contract is available. The date on which the first Service under the contract is available is the Membership Charge Date as defined above and upon which Services are available to any Founding Member and the three (3) business day period shall be defined as the “Presale Termination Period.

  1. If you cancel within the Presale Termination Period, Heyday will fully refund any charges paid, less any discounts redeemed, within thirty (30) days of receipt of your cancellation notice.

  1. Any termination made prior to store official opening must be made in writing by sending an email to the Heyday location email listed on the website or to members@heydayskincare.com. That email must include your name, your address, the last four digits of the payment method used to pay for the Membership, the date the Presale Contract was signed and a statement that you wish to cancel your Presale Contract. You understand that should you fail to comply with this section, your Membership will not be considered cancelled and you will be billed pursuant to the agreed-upon terms above until such cancellation provisions are completed.

  1. CHANGES: We have the right to change or add to the terms of this Agreement at any time, solely with prospective effect, and to change, delete, discontinue, or impose conditions on use of the Services by posting such changes on our website or any other website we maintain or own. We will provide you with notice of any changes via email, or through other reasonable means. For existing Members, the changes will come into effect 10 days after we post the changes to our website, and your use of the Services more than 10 days after we publish any such changes on our website, constitutes your acceptance of the terms of the modified Agreement. You can access a copy of the current terms of this Agreement on our website at any time. You can find out when this Agreement was last changed by checking the “Last updated” date at the top of the Agreement.
